Rule of law

The European Union is a Union of values: it is founded on the values of respect for human dignity, freedom, democracy, equality, the rule of law and respect for human rights. These values are common to the Member States, and no country can become a member of the EU without adhering to and supporting these values.

The rule of law is one of the core principles on which the Union is based: it that allows European citizens freely to exercise their civic rights. We are, however, witnessing an  increase in violations of the rule of law in various the Member States, especially in the area of fundamental freedoms and political rights. The current EU framework is ill-equipped to deal effectively with such violations, leaving the abuse of citizens’ rights unaddressed.

This is why we call for:

  • the introduction of a European Review Mechanism on Democracy, Rule of Law and Fundamental Rights, as proposed by the European Parliament. This mechanism would allow for a regular scoreboard for fundamental rights as well as introduce a systematic fundamental rights assessment for legislative proposals, similar to the already existing assessments of proportionality and subsidiarity for any EU legislative proposals.
  • for the increased capacity of the European Court of Justice to deal with breaches of the rule of law in EU Member States, as these endanger the rights of Europeans
